She noted that Border Patrol had recorded more than 89,000 apprehensions across the 517-mile sector over five years, yet Big Bend had the lowest apprehension rate per mile of any sector along the southern border.

Towering 1,500-foot cliffs, the Chisos Mountains, and waterless desert expanses make travel through Big Bend exceptionally punishing, leading Customs and Border Protection to acknowledge in May that the topography of the area naturally deters foot traffic across the border.

On October 21, the Trump administration pushed back, arguing in a filing sent to the Supreme Court that delaying construction imperils national security.

“The Sinaloa and Juarez cartels operate south of this sector across the Mexico border and seek to exploit any vulnerabilities in United States border protection to traffic humans, drugs, and weapons,” Justice Department attorneys wrote in the filing, saying that leaving a “300-plus-mile gap in border defenses” could attract criminal organizations.

In an October 30 reply, the administration maintained that the judge lacked authority to halt construction and reiterated that the injunction threatened border security.

Centuries of Impact on Land and Lives

Opponents argue that allowing work to resume before the lawsuit is resolved could cause irreversible environmental damage.

Jeffrey Renfrow, an ecologist and director of Rio Bravo Restoration who has worked in the Big Bend region for more than two decades, testified that the damage already done could outlive generations.

“My opinion is that there’s been significant harm to hydrologic function, vegetation and soils and that that harm will probably persist for decades if not centuries, and, in some cases, never recover,” Renfrow told the court.

Bulldozers and other heavy machinery can crush biological soil crusts, delicate living mats that bind the desert floor together and prevent erosion. He also described the emotional toll of watching the landscape around his home change.

“I’ve cried a river of tears seeing what they’ve done to my home,” he told the court. “I just see this kind of like a dystopian nightmare in my very home, a place that I hold sacred.”

The administration had previously used special legal exemptions to begin construction without completing certain environmental reviews and meeting other legal requirements. Cardone’s order blocked further work under those exemptions.

If the Supreme Court lifts her order, construction could resume while the lawsuit continues.
